Quel que le soit le terme privilégié pour parler de la smart city, il ne peut être fait l'impasse sur ce qui la structure et l'alimente : les données urbaines. En effet, la collecte, le traitement et la réutilisation de cette matière première, au coeur de la smart city, est l'un des enjeux des expérimentations et réalisations mises en oeuvre. Pourtant, une définition précise de ce qu'est une donnée urbaine manque, de même qu'un cadre juridique adapté. Un autre des enjeux de la smart city repose sur l'organisation des systèmes de données urbaines, lesquelles restent encore à définir et concrétiser, notamment avec l'aide des textes juridiques les plus récents, comme en France la loi n° 2016-1321 du 7 octobre 2016 pour une République numérique. En outre, les expérimentations menées sur la smart city et les données urbaines reposent toutes sur l'open data, faisant petit à petit migrer celui-ci vers un open data que l'on peut qualifier d'"urbain". L'usage de ces données suppose alors que soient bien distinguées (et distinguables) les nuances entre données publiques et données privées, données personnelles et données non personnelles, nuances qui ne se recoupent pas nécessairement.
